Le mercredi 10 octobre 2007, le juge Simon Noël, de la Cour fédérale, a décidé de maintenir les conditions de libération d'Adil Charkaoui malgré que les certificats de sécurité à l'origine de ces conditions aient été jugés anticonstitutionnels.

NO NEW SECURITY CERTIFICATE LEGISLATION
FREE THE SECRET TRIAL FIVE
Minister of "Public Safety" Stockwell Day is expected to introduce new security certificate legislation in Parliament any day now. The reform comes in response to strong public opposition to the security certificate - a symbol of injustice against migrants in Canada - and in response to the Supreme Court decision in February 2007 that the 'security certificate' process is unconstitutional.
This means that the government intends to maintain a two-tiered justice system, with one process for refugees and permanent residents and another for citizens. If it succeeds, this move will further entrench the use of secrecy and racial profiling in the Canadian legal system. It will help to normalize indefinite detention/house arrest for people who are deemed "suspect" by the spy agency CSIS. It will normalize increased government control and surveillance. All while leaving the door open to deportation to torture.
JOIN US on the cross-Canada day of action on 20 October to send a clear message to the government: no new security certificate process; immediately free those detained under this illegal law - or charge them and give them a fair and open trial.

posted on October 18, 2007 | in Category Security Certificates | PermaLinkOn Wednesday October 10, Justice Simon Noël of the Federal Court ruled that restrictions on Montrealer Adil Charkaoui, originally imposed by the security certificate process which has since been struck down, must remain in place to "neutralize" the potential threat represented by Charkaoui.

Adil Charkaoui, a Montrealer under a federal security certificate, will have to keep wearing a Global Positioning System device that has monitored his every movement since Feb. 17, 2005, a Federal Court of Canada judge ruled Wednesday morning.
"The request for Mr. Charkaoui's provisional liberation without conditions is denied," Judge Simon Noel concluded in a 26-page judgment.
Mr. Charkaoui remains unable to travel outside Montreal without Mr. Noel's permission. He is also required to be supervised at work, and accompanied at all times by specified people when outside his home.

Toronto Action: Toronto Says No to Secret Trials

The six-year campaign against secret trials won a major victory in February when the Supreme Court ruled that security certificates were unconstitutional.
However, the Harper government has already announced that it will introduce NEW security certificate legislation this fall. This is likely to be based on the “special advocate” model, which will further entrench the use of secrecy in the immigration and justice systems.

The campaign against secret trials won a victory in February when the
Supreme Court recognized that the "security certificate" is
unconstitutional.
However, the Supreme Court gave the government one year before the law
falls. All five detainees thus remain in indefinite, arbitrary detention or
house arrest conditions, under threat of deportation to torture - under a
law that has now been recognized as illegal.

Lawyer for accused terrorist seeks access to Guantanamo detainee

OTTAWA (CP) - The lawyer for an accused terrorist living in Canada is demanding access to Abu Zubaydah, a key al-Qaida operative held at Guantanamo Bay, to find out first-hand what Zubaydah knows about his client.
Paul Copeland, counsel for Algerian-born Mohamed Harkat, has written to officials in both Ottawa and Washington saying he needs to interview Zubaydah to mount a proper defence of Harkat, who is accused by Canada's secret service of having terrorist ties.
So far U.S. authorities have replied only that the interview request is under consideration and a decision "may take some time." There has been no response from the Canadian government.
The Canadian Security Intelligence Service, in previous court proceedings against Harkat, has claimed he was identified by Zubaydah as the operator of a safe house for Islamic militants in Peshawar, Pakistan.
CSIS also claims to have additional evidence - heard behind closed doors by a Federal Court judge but never made public - linking Harkat to Zubaydah.
